Acceptance of Terms

Once a written agreement is signed and a deposit is received (if applicable), we will schedule your project based on crew availability and material lead times. We will provide you with a start date and an estimated completion window.

If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellation terms, including any applicable deposit refund policy, will be stated in your written contract. We reserve the right to charge for materials ordered or work already performed at the time of cancellation.

We may reschedule work due to weather conditions, crew availability, material delays, or other factors beyond our control. We will notify you promptly and work to reschedule at the earliest available time.

Payment Terms

Payment terms will be specified in your written contract. Unless otherwise agreed in writing, payment is due upon completion of the project or upon each milestone as defined in the contract.

Accepted payment methods will be stated in your contract. Invoices not paid within the time specified may be subject to a late fee. We reserve the right to stop work or withhold completion of a project until outstanding balances are paid.

California law requires contractors to provide specific disclosures related to down payments. Any deposit required will be clearly stated in your written contract and will comply with applicable law.

Permits and Approvals

Where required, we will obtain building permits on your behalf as part of the project. Permit fees will be included in your written quote. It is your responsibility to obtain any HOA approvals, neighbor approvals, or other non-governmental approvals required for your project before work begins.

If permits are delayed by the city or county for reasons outside our control, project timelines may be extended. We are not responsible for delays caused by permitting authorities.

Warranty Disclaimers

Any warranty on workmanship or materials will be stated in your written contract. Unless otherwise specified in writing, our warranty covers defects in workmanship for one year from the date of project completion.

Warranties do not cover damage caused by acts of nature, vandalism, misuse, failure to maintain the fence as recommended, or modifications made by anyone other than us after installation.

THE SITE AND ANY INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of Liability

To the fullest extent permitted by law, SRS Santa Rosa Fence Builder and its employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from the services we provide.

Our total liability to you for any claim arising from the services we provide will not exceed the total amount paid by you for the specific project giving rise to the claim.

We carry general liability insurance. A certificate of insurance is available upon request.

Dispute Resolution

If a dispute arises between you and us, we ask that you first contact us directly so we can try to resolve it informally. Most issues can be resolved with a direct conversation.

If informal resolution is not possible, disputes will be resolved through binding arbitration in Santa Rosa, California, under the rules of a mutually agreed arbitration provider, unless applicable law requires otherwise. You waive any right to a jury trial or class action.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent irreparable harm.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action not subject to arbitration will be brought in a court of competent jurisdiction in California.

Intellectual Property

All content on the Site - including text, images, graphics, and logos - is the property of SRS Santa Rosa Fence Builder or its content providers and is protected by copyright and other applicable laws.
